Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The employer did not protect employees who operate the Yale Fork truck from being crushed between the Roll Over Protection System (ROPS) and the ground or other fixed structure when it failed to equip the fork truck with a seat belt. The Yale Fork truck was not equipped with a seat belt. Among other methods, one feasible and acceptable abatement method to correct the hazard is to retrofit the fork truck with a seat belt.
