Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) the hazards of falls in that, on the south side of the building, an employee were observed being elevated by a forklift, while standing on a wooden pallet, performing steel erection. The pallet was not securely attached to the forks of the lifting device and the wooden pallet did not have any fall protection. Among other methods, one feasible and acceptable abatement method to correct the hazards above would be to provide the employees with a safety platform firmly secured to the lifting carriage, equipped with guardrails and approved by the forklift manufacturer.
