Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:the hazards of confined spaces in that rescue could be
delayed by the accidental
disengagement of the snaphook from the "D" Ring of the harness.
a)  The employer did not provide employees with snap hooks designed to
lock closed in
order to prevent the accidental disengagement of the snap hook and D-ring,
or in the alternative:
CFR 29 1926.502(d)(5):  Snaphooks shall be sized to be compatible with the
member to which
they are connected to prevent unintentional disengagement of the snaphook
by depression of the
snaphook keeper by  the connected member, or shall be a locking type
snaphook designed and
used to prevent disengagement of the snaphook by the contact of the
snaphook keeper by the
connected member.  Effective January 1, 1998, only locking type snaphooks
shall
be used.
Among other method to correct this hazard is to use only those snaphooks
that automatically lock
when the snaphook keeper is released.
