Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of developing nasal, lung, or throat
cancer from the
inhalation of harmful levels of oak wood dust:
(a) Employees working in the production shop manufacturing oak furniture
are exposed to
airborne levels of oak wood dust ranging from 1.1 mg/m3 to 2.5 mg/m3 as an
8-hour time
weighted average.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to reduce dust levels by using a combination of one or more of the
following:
1) The use of down-draft sanding tables.
2) The use of local exhaust dust collectors attached to the tools.
3) The use of recirculating dust collectors for general area use.
4) The use of sanders in a manner which limits dust discharge in the
employees
breathing zone.hing
