Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of being burned by a flammable liquid fire on or about August 7, 2003 and at times prior thereto while operating an air compressor in a potentially flammable atmosphere created by the storage of unsecured portable gasoline containers in the bed of a pickup truck while working on Highway 87 north of Loma, Montana. Among other methods, one feasible and acceptable abatement method is to prohibit the placing of flammable liquids near air compressors.
