Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by natural stone slabs during manual handling of the slabs: a) On November 14, 2002, and at times prior thereto, employees were exposed to the hazard of being crushed by approximately 1,400 pound natural stone slabs while manually handling slabs stored in an "A" frame rack. Or In the Alternative: 29 CFR 1910.176(b); Bags, containers, bundles, etc., stored in tiers were not stacked, blocked, interlocked or limited in height so that they were stable and secure against sliding or collapse: a) Natural Stone Yard: Employees exposed to the hazard of being crushed by natural stone slabs when balancing them by hand.
