Nevada Revised Statute 618.375(1):  The employer did not furnish
employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees in that:
The employer did not provide the proper equipment to employees working at
the
following location:
a.South and southwest walls of the warehouse.  Employees were
stepping on and from the top step and top of a Werner 8' step
ladder to store/retrieve merchandise on/from the top tiers of
storage racks that were approximately 11'6" high.  The short
ladder combined with the lack of fall protection for the employees
when they worked from the horizontal beams of the storage racks,
exposed them to potential falls from a height of approximately 8'-
11'6" to the concrete floor below.
REFERENCE:  ANSI A14.2-1990, 8.3.2:  The user shall not step or stand
higher
than the step or rung indicated on the label marking the highest standing
level of
a ladder.  The user shall not step or stand on:  a ladder top cap and the
top step
of a step ladder or trestle ladder, or the bucket or pail shelf of a
self-supporting
ladder.  Note:  The Werner ladder had an affixed instruction/caution label
that
indicated, "DO NOT STAND ABOVE 2ND STEP FROM TOP."
The employer had procured a Cotterman 1700 Series, 12' Platform Ladder for
employees to use to abate the potential fall hazards described above.
