Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to the hazard of being struck-by the grapple of the locomotive crane while attempting to clear a jam in the throat of the shear: a)On or about, 08/02/01, there was no means of communication in place to ensure that the crane operator knew the location of the shear box operator prior to activating/moving the crane's grapple. Among other methods, one feasible and acceptable abatement method would be to follow the requirements as sent forth in ANSI B-30.5-1969 and B-30.5-1994, Section 5-3.3.1, and ensure that the crane operator and affected employees are in constant communication with each other via hand signals or voice communication (radios) when the crane is in operation.ion
