Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the following condition(s):
a)  On 7/6/01 and at times prior to that date, hoppers were exposed to the
hazard of
being struck by a garbage collection and compacting vehicle as they rode
on the back of
the McNeilus Rear Loader as it moved in reverse.
Among other methods, some feasible and acceptable abatement methods to
correct
this
hazard is to:
(1) ensure that employees assigned to work as hoppers and drivers are
trained in the
company's policy prior to assignment, the equipment's operation manual and
the
American National Standard (ANSI) Z245.1-1999, paragraph 6.2.5.4(a) which
prohibits
riders on the back of the truck as it moves in reverse.
(2) develop a safety program consistent with the requirements of ANSI
Z245.1-1999,
clause 9
(3) implement a training program for employees consistent with the
requirements of
ANSI Z245.1-1999 clause 6.1.3 and 9.
