Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of falling into and unguarded elevator shaft. a) Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the entrance to the elevator shaft located on the 3rd floor of the sugar mill is guarded in accordance with ASME A17.1 Section X (Safety Code for elevators and Escalators), Section 110 Protection of Hoistway-Landing Openings, Rule 110.1 Entrances and Emergency Doors Required. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the elevators utilized by employees in the sugar mill are inspected in accordance with ASME A17.1 Section X (Safety Code for elevators and Escalators), Part X (Routine, Periodic, and Acceptance Inspections and Tests), Section 1001 Routine Inspection and Tests of Passenger and Freight Electric Elevators, Rule 1001.1 Inspection and Test Periods.
