Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following conditions: a) Directorate of Public Works (DPW) employees of the Maintenance and Operations Division are exposed Asbestos Containing Material (ACM) when performing Class III asbestos work throughout the Ft. Polk Army Installation. Employees work around ACM when performing job tasks including, but not limited to, removing thermal insulation from pipes, valves and pumps for mechanical repairs; moving electrical lines through crawl spaces; cutting into ceiling tiles and wallboards; cutting plumbing lines; and when making other miscellaneous maintenance repairs in areas such as mechanical rooms, boiler plants, living quarters, dining facilities, and other buildings at the installations. Among other methods, one feasible and acceptable abatement method to correct this hazard and/or prevent employee exposure would be to implement and adhere to Army Regulation (AR) 420-70, Buildings and Structures (10 Oct 97) and U.S. Army Center for Public Works Technical bulletin TB 420-70-8, Installation Asbestos Management Program (23 Mar 98). AR 420-70 contains the Army's facilities policy for asbestos. AR 420-70 requires all U.S. Army installations to develop and implement an asbestos management program to evaluate and control asbestos-containing materials in Army facilities. This asbestos management program shall include surveys and monitoring to identify the presence, location, extent and condition of ACM throughout the Ft. Polk Army Base. TB 420-70-8 is a guidebook that is intended to help installations comply with Army policy by developing and implementing an effective asbestos management program. In addition, the Asbestos Management Plan designed to meet the objectives of AR 200-1, Chapter 8: "Asbestos Management", provides the required guidelines that are essential to the prevention or minimizing of asbestos exposure to all DPW/Maintenance and Operations personnel.
