Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
At 7010 Krick Road, Walton Hills, Ohio on 06/22/01:  Employees were
exposed to struck-by
and crushed-by injuries from a building that had obvious structural
deficiencies in danger of
failure which was likely to cause death or serious physical harm to
employees performing work
duties inside of the facility.
Among other methods, one feasible and acceptable means to correct the
hazardous condition may
include:
a.  Provide a design from a Registered Professional Engineer (PE) licensed
in the State of Ohio
to repair the structural elements of the building in accordance with
provisions
contained within
the Ohio Basic Building Code (OBBC).
b.  After completion of the design, apply for a building permit with local
building authorities
to ensure compliance with local building codes.
c.  Award a construction contract based on a. and b. above to a contractor
licensed to perform
work in the geographical area of the facility who regularly performs such
work.
d.  Complete the required repairs through the means suggested herein
thereby alleviating the
hazard in accordance with standard procedures established by City, County
and State law.
