Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling steel storage racks, or the components of the steel storage racks, including any materials stored on the racks: The employer did not ensure that commercial steel storage racks in use at the facility were inspected and maintained in accordance with the manufacturer's requirements and with the American National Standards Institute guidelines for the use of industrial and commercial steel storage racks: a) In the casepack area, where a rack collapsed on 06-15-2001, the uprights were bent, bowed and corroded. These hazards are identified by the American National Standards Institute (ANSI MH16.2-1984) in Section 1, Paragraph 1.3 (Collision Protection); Section 3, Paragraph 3.11 (Damaged Racks); and Section 3, Paragraph 3.12 (Deteriorated Racks) as being causes for the compromise of structural integrity and structural stability, both of which can lead to rack collapse.
