Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: DoAll metal cutting band saws MP426 and MP12108 in Department 16, and Wilton metal cutting band saw MP31244 in Department 13 were not equipped with magnetic restarters or a similar device, as prescribed by the American National Standard for Metal Cutting Saws, ANSI B11.10-1990, Section 5.2.3.4, that in the event of a power interruption in the electrical supply, would prevent the saw from restarting automatically when power is restored. Abatement certification only is required for this item in accordance with the requirements of 29 CFR 1903.19(c).s
