General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A) 11 Center St. Newark, NJ The hazard of being struck or crushed by loads of metal pipe pilings which were being unloaded without proper unloading equipment being used. Employee was manually unloading a load of 19 metal pipe pilings from a flatbed vehicle. Employee was exposed to the hazard of being in front of the live side ( unloading side) which was not secured to prevent unexpected and uncontrolled displacement of the approx. 45,000 lbs of metal pipe pilings. Among other methods, feasible and acceptable abatement methods to be used in the unloading of piles may inslude use of a forklift, or mobile crane of sufficient size to safely handle the load size and weight expected, or by manual means of unloading that keeps employees free from striking and crushing hazards.
