Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees working with, and in the vicinity of, suspended loads were exposed to the hazard of being struck by falling loads due to jib crane and hoist, or pressure gripping lifter (plate clamp) failure. Employees were exposed to the hazard of falling loads in that pressure gripping lifters (plate clamps) were not being inspected on a frequent and periodic basis and clamps with undetected faults remained in service. Employees were further exposed to the hazard of falling loads in that hoists and jib cranes were not being inspected on a frequent basis, and hoists or jib cranes were in service with undetected faults or unsafe conditions. Among others, feasible and acceptable methods to correct this hazard would be to implement inspection and maintenance programs which comply with the provisions of ANSI/ASME (American National Standards Institute / American Society of Mechanical Engineers) B30.20 safety standard for Below-The-Hook Lifting Devices, and with provisions of ANSI B30.11 the American National Standard for Monorail Systems and Underhung Cranes.
