General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) being crushed by or caught between the forklift and the ground/concrete floor in the event the vehicle was up-set or turned over. The operator was not wearing the installed seat belts while operating the 3000 lb, Nissan 30, squeeze forklift, s/n KCPHO1P900200. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the operators to wear seat belts while operating the forklifts.
