North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees in that employees were
exposed to:
a)being crushed by or caught between the forklift and the ground in the
event of an
overturn hazard.  An employee, operating the Toyota Forklift next to the
warehouse, was not wearing the seat belt while operating the forklift.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to train employees and enforce the wearing of seat belts
while
operating forklifts with a Roll Over Protection system (ROPS) or a Fall On
Protection System (FOPS).
b)being crushed by or caught between the forklift and the ground in the
event of an
overturn hazard.  The Toyota Forklift, located in the Impregnating Room,
was
not equipped with a seat belt.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to retro-fit any forklifts, purchased without a seat belt,
with seat
belts from the manufacturer, then to train the employees and enforce the
wearing
of seat belts while operating forklifts with a Roll Over Protection system
(ROPS)
or a Fall On Protection System (FOPS).
