North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees in that employees were
exposed to:
a)construction site, Franklin Boulevard, Greensboro, NC - employee was
observed
and photographed while operating a front end loader on a public right
while not
wearing the manufacturer's supplied seat belt.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to train employees to wear the safety belt whenever they are
operating the equipment and to enforce the wearing of the safety belt while
operating equipment with Roll Over Protection System (ROPS) or a Fall On
Protection System (FOPS).
