North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being struck by falling load - below the hook lifting device in the battery changing room was not marked with the requirements set forth by ANSI B30.20- 1.2. REFERENCE:ANSI B30.20-1.2 - Below The Hook Lifting Devices, Markings and Construction: (b) Identification - A nameplate or other permanent marking shall be affixed displaying the following information: (1)manufacturers name (2) serial number (3)lifter weight (4)rated load Among other methods, one feasible and acceptable means of abatement is to have all Below the hook lifting devices tested, inspected and marked with all applicable information.
