North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being struck or caught in between the lift and ground in the event employees fall or get thrown off. The employees operating the 534 Gradall forklift, were exposed to being caught in between/crushed from not using the installed seat belts. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train/certify and inspect employees on wearing seatbelts installed by the manufacturer of the Gradall forklift.rer
