North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)logging yard - being crushed by or caught between the forklift and the ground in the event the vehicle was up-set. Seat belts were not installed for the operator's protection on the seat of the John Deere forklift, s/n 544 CB 401055D1, Model 544C, being used to move logs around the logging yard. Among other methods, one feasible and acceptable abatement method to correct this hazard was to install seat belts at the operator's station and to the operator to wear the installed seat belts while operating the forklift.
