North Carolina General Statute: 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)the hazard of operating/driving the 1981 GMC dump truck, Virginia license number 11043P, without the driver restraining himself with the approved seat belt assembly provided, on November 2nd, 2001. Among other methods, one feasible and acceptable abatement method would be to develop a written company policy that specifically addresses seat belt use. The policy would include educational and disciplinary procedures for the drivers of the company.
