North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being crushed by or caught between the forklift and the ground in the event of an overturn. Two Clark forklifts, used for general use (moving materials and stock, loading/unloading trucks), were not equipped with an Operator Restraint System (seat belt). Among other methods, one feasible and acceptable abatement method to correct this hazard is to have the forklifts retrofitted with an Operator Restraint System, then to train employees and enforce the wearing of seat belts while operating the forklifts.
