Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling approximately three stories to the
ground:
a.Site - An employee was sitting on the top rail of the gate, with one leg
on the
outside of the platform and one leg inside the platform while working from
a
platform affixed to the forks of a Lull 844C-42 lift.  He was not wearing
fall
protection.
b.Site - An employee had used the railings of the platform to gain
additional height.
c.Site - The midrail on the basket was damaged (bent), and deflected about
4 inches
downward.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable means of
abatement
would be to comply with the requirements of the American National
Standards Institute (ANSI)
B56.6 - 1992 and (Addenda B56.6a - 1994) to ensure that employees maintain
firm footing on
the platform floor unless secured by a fall protection system.  Also, the
railing of the platform
must be repaired or replaced.
