Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to fall and crush hazards. a.Route 3A at I-93 South On-Ramp Exit 10 --- An employee, other than the operator, was allowed to ride on the model 926 Caterpillar Wheel Loader there- by exposing them to falling off the moving equipment and being struck by the moving equipment or other vehicles. ABATEMENT NOTE: Among other method, one feasible and acceptable method of abatement would be not to allow riders on the machine unless additional seat, seat belt and Rollover Protective Structure (ROPS) are provided per the Caterpillar Model 926 Operator's Manual, Safety Section.
