Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to fall and crush hazards. a.Jobsite, in front of building; An employee, other than the certified operator, was allowed to operate the Lull forklift without wearing the personal restraining system, (seat belt), thereby exposing the operator to injuries caused by but not limited to striking the steering wheel, controls, windshield and/or falling out of the forklift and being crushed by same forklift or other vehicle. ABATEMENT NOTE: Among other methods, one feasible and acceptable method would be to train operators in and require and enforce the use of seat belts.e
