Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)were exposed to the hazard of being struck by portions of the concrete
pumping
equipment at the jobsite located at 10550 West Sam Houston Parkway, where
employees were engaged in pouring tilt slab panels for the walls of the
warehouse
on site.
Among other methods, one feasible and acceptable abatement method, to
remove
this hazard from the workplace is to follow the general guidelines found
in the
Schwing America, Inc., Safety Manual, version 2.0.3, specifically Section
6.24,
page 23, Check Soil Conditions, Section 6.25, page 23, Test The Setup, and
various provisions of the manual that require the use of substantial
timber,
cribbing or other structural members beneath the vehicles's outrigger pads
sufficient to distribute the load.
