Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not utilized the proper lifting procedures of the manufacturer resulting in an employee being struck by the falling structure. The employer utilized a lifting procedure that was prohibited by the manufacturer. A spreader bar was not utilized to lift a manhole weighing 5000 Lbs. One of the EZ lifting pins failed causing the manhole to hang from the other EZ lifting pin and hitting an employee in an excavation. Among other methods, one feasible and acceptable abatement method to correct the hazard is to train employees to utilized manufacture's procedures for lifting. Ensure that the employees understand those procedures that are prohibited by the manufacturer. The Ez Pin Lifting Procedures of the Lane International Cooperations clearly states to always lift structure using a spreader bar, and lift in a straight, vertical manner taking care not to damage to structure. This assures maximum lifting capacity and safety. Also insure that the appropriate or specified equipment is utilized to lift structures that pertains to that manufacturer. Disclaimers: 1.
