Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
provide a place of employment that was free from recognized hazards that
were likely to cause
death or serious physical harm to employees in that employees were exposed
to:

Having their head and torso entrapped between the truck and ground in the
event of a tip-
over accident when not wearing the seatbelts provided and resulting in
crushing accidents
and death.
CERTIFICATION REQUIRED FOR THIS ITEM Feasible means of abatement would
include wearing seatbelts at all times while operating powered industrial
trucks provided
with them in compliance with the following American Society of Mechanical
Engineers
(ASME)/American National Standard Institute (ANSI) Safety Standards:
ASME/ANSI
B56.1-1988, Section 5.3.19, Powered Industrial Trucks ASME/ANSI B56.1a-1989
Addenda to ASME/ANSI B56.1-1988 ASME/ANSI B56.1-1993 Safety Standard for
Low
Lift and High Lift Trucks.

employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
***Certification AND Documentation of Abatement Required***
Crushing and amputation hazards during the movement of railcars and the
alignment of rail
couplers for the joining of railcars. Among other procedures, one feasible
and acceptable
abatement method to correct the hazard is to follow the procedures as
outlined in Part 220 of The
Federal Railroad Administration.

Sec. 220.49  Radio communication used in shoving, backing or pushing
movements.
When radio communication is used in connection with the shoving,
backing or pushing of a train, locomotive, car, or on-track equipment,
the employee directing the movement shall specify the distance of the
movement, and the movement shall stop in one-half the remaining distance
unless additional instructions are received. If the instructions are not
understood, the movement shall be stopped immediately and may not be
resumed until the misunderstanding has been resolved, radio contact has
been restored, or communication has been achieved by hand signals or
other procedures in accordance with the operating rules of the railroad.
