Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY FALLING EQUIPMENT: a)Battery room hoist, on or about 10/24/2001: One below-the-hook lifting device had no rated load markings and no inspections performed. Among other methods, feasible and acceptable methods to correct each of these hazards are to: 1.Rate and mark the load capacity of the lifting device on a tag/plate or equivalent. 2.Conduct frequent and periodic inspections of the lifting device in accordance with ASME B30.20-1993. b)Battery room overhead hoist, on or about 10/24/2001: A Coffing, 2 ton, overhead hoist, Serial Number unknown had no maintenance records, to indicate annual or more frequent inspections. Among other methods, feasible and acceptable abatement methods to correct this hazard are to: 1.Conduct frequent and periodic inspections of all hoisting equipment. 2.Maintain dated inspection reports or comparable records on critical items such as hoisting machinery and other lifting devices in accordance with ANSI B30.17-1990, Chapter 17-2. Abatement certification must be submitted for these items.
