Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fire hazard: a)Shack at top of lift #4, On or about 1/25/02: Employees were exposed to a fire hazard caused by an improperly installed, used, and maintained heater. The heater was mounted to a wall, used inside of the shack, had the gas controller away from the heater area, was being lit improperly, and was being operated without it's front guard. Among other methods, several feasible and acceptable methods to correct these hazards are to: 1.Follow the requirements of the manufacturer of the heater regarding guarding and installation. 2.Follow the requirements of the New York State Building code, 1163.8 (d) regarding guarding and use. 3.Follow the requirements of the National Fire Protection Agency, 3-4.10 regarding installation, gas tubing and use. Abatement certification must be submitted for this item.
