Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING CRUSHED-BY THE MACHINE : a)Shipping/Receiving, on or about 5/30/02: (1) 1995 Nissan model 50, forklift used by employees to move material around inside building was not provided with seat belts. Forklift did have a roll-over protective structure. ABATEMENT NOTE: One feasible means of abatement is to install a seat belt and require its use by employees.
