Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING CRUSHED-BY THE POWERED INDUSTRIAL TRUCK: a)Building 324 Loading Ramp/dock, on or about 08/27/2002: An employee was not wearing seatbelts provided while operating a Hyster powered industrial truck, SN: C10868324k-8001, Model: X40XL, and was thrown from the vehicle during an accident. ABATEMENT NOTES: Among other methods, one feasible and acceptable abatement method to correct this hazard is to require employees to wear seat belts when operating powered industrial trucks in accordance with ASME B56.1-1993, chapter 5.3.19. Abatement certification must be submitted for this item.
