Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD: a)Process area, on or about 12/18/02: Overhead hoist used for lifting materials including but not limited to; pallets of 5 gallon cans. 1)Hoist was not being inspected on a frequent and periodic basis. 2)Load hook was missing a safety clip. ABATEMENT NOTES: Among other methods, one feasible method of abatement is to: 1). Conduct frequent and periodic inspections of the electric hoist for wear, deterioration and malfunction as per ANSI B30.16-1987. 2). Install a safety clip on load hook as per ANSI B30.16-1987. Abatement certification must be submitted for this item.
