Minn. Stat. 182.653 subd. 2:  The employer did not furnish to each
employee, conditions of
employment and a place of employment free from recognized hazards which
caused or were
likely to cause death or serious injury to employees; specifically:
The employer failed to ensure that truck drivers were not allowed in
hazardous areas
while trucks were being loaded at the Trus Joist facility outside shipping
area.  A
fatal injury occurred to a trucking company employee on 7/23/01. A bundle
of wood
product material fell from a semi-truck bed, while being loaded by an
employee of
Tus Joist, who was operating the forklift.
