Minn. Stat. 182.653 subd. 2:  The employer did not furnish to each
employee, conditions of
employment and a place of employment free from recognized hazards which
caused or were
likely to cause death or serious injury to employees:
On June 26, 2001 an employee was setting (loading) a pre-formed concrete
panel on a
flatbed semi-trailer.  After unhooking the rigging, the panel fell and
severely injured the
employee.  The employer failed to provide and enforce specific, safe
operating
procedures for employees to follow in order to safely load pre-formed
concrete panels
onto flatbed semi-trailers, and to determine when deteriorated equipment
(A-frames and
trailer planking) becomes unsafe for a specific job and should not be used.
Abatement Guidelines:
1) The employer shall develop specific, safe operating procedures for
setting (loading) pre-
formed concrete panels onto flatbed semi-trailers.
2) The employer shall develop a procedure for inspecting A-frames and
trailer planking to
determine when they are unsafe to use and when they should be repaired or
replaced.
3) The employer shall train all employees who participate in setting
(loading) pre-formed
concrete panels onto flatbed semi-trailers in these safe operating
procedures.rs
