Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to injury, while operating a forklift, without fastening the
installed seatbelts on
or about June 14, 2002.
"AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS":
1. Instruct powered industrial truck operators to follow manufacturer's
suggested safe practices
and warnings as written in the operator's manual.  Operators should wear
installed seatbelts in
order to protect them from injuries subsequent to rollovers or other
accidents.
2. Incorporate a block of instruction in the use of seatbelts into the
powered industrial truck
training and certification program.
3. Managers should enforce the use of seatbelts by all employees operating
powered industrial
trucks.
4. Managers should stress the use of seatbelts during all safety meetings
and ensure guidance
on the use of seatbelts is written into all company procedure and training
documents referencing
powered industrial trucks.
