Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees working with the Skyjack SJKB-33N boom-supported elevating work platform were exposed to the hazards of falling from or with the unit, or being struck or crushed by the unit due to the potential for improper operation and/or potential use of the unit with undetected faults or unsafe conditions due to lack of familiarization with the manufacturer's requirements for daily inspections and appropriate operation of the vehicle. Among others, feasible and acceptable methods to correct this hazard would be to establish and implement a training program which complies with the provisions of ANSI A92.5, The American National Standard for Boom-Supported Elevating Work Platforms, including provisions for familiarizing employees with the owner's operating instructions and safety rules, and instructions relative to the manufacturer's daily safety inspection requirements for such vehicles.
