Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being crushed or struck by loads such as metal sheets
being lifted by magnets
in that:
a) Magnets used to lift material were not marked to indicate its lifting
capacity, manufacturer
name, duty cycle, cold current, voltage and  serial number as required by
ASME B30.20-4.2-
1993 for remotely operated lifting magnets.
b) Magnets used to lift material were not inspected for defect prior to
use and periodically as
required by ASME B30.20-4.3.1-1993 for remotely operated lifting magnets.
A feasible and acceptable method of abating these conditions would be to
insure that all magnets
are properly marked, load tested, inspected and certify in accordance with
ASME
B30.20-1993
for Below the Hook Lifting Devices
