Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure an employee was protected while working in a scissor lift under the following condition: a.The West side of the building, approximately 10 feet in the air, an employee was working from a scissor lift without utilizing the required fall protection device while straddling the top railing of the guardrail system. Reference: ANSI 92.6 - 1979 Self -propelled elevating work platform. - section 14.2.6: Personnel shall maintain a firm footing on the platform while working thereon unless they are secured by safety harness/lanyard devices fixed to manufacturer approved hard points. One feasible means of abatement is to ensure that the employees use the required safety harness/lanyard when appropriate.
