Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure that warehouse employees being elevated by a forklift were protected by using an approved work platform. a.In the warehouse, employees requiring access to the upper levels of a storage rack were being lifted on a pallet by a forklift, instead of using an approved work platform, exposing them to a fall hazard of up to 12 feet. Reference: ASME B56.1-1993 Powered and Nonpowered Industrial Trucks - sections 4.17 & 7.35 - Only operator-up high lift trucks have been designed to lift personnel. If a work platform is used on trucks designed and intended for handling materials, the requirements of paragraphs 4.17.2 and 4.17.3 shall be met for the protection of personnel. One feasible means of abatement would be to make sure that only an approved work platform is used to lift personnel with a forklift.
