Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Fall Hazards associated with working on a Scissor Lift. (a)At the Jobsite/Waldbaums Supermarket - A United 800 Series Self Propelled Elevating Work Platform [Scissor Lift] #SL519 was elevated 8ft high. An employee was observed climbing up the guardrails to a 13ft high steel I-beam without fall protection; On or about 4/28/03. ABATEMENT NOTES: Among other methods, one feasible method to reduce this hazard is to: Train the operators to comply with ANSI Standard A92.6-1979 in Section 14.2. "Self propelled Elevating Platforms" and Section 14.2.6 which states "Personnel shall maintain a firm footing on the platform thereon unless they are secured by a safety harness/ lanyard fixed to manufacturer approved hard points. Use of railings, planks, ladders or any other device on the work platform not conforming to Section 14.3.3 for achieving addition height shall be prohibited." ABATEMENT VERIFICATION IS NOT REQUIRED AS OUTLINED IN PART 29 CFR 1903.19
