Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by falling ice while manually moving fragmented ice from a pile to a floor auger (conveyor). (a)On or about September 19, 2001, employees working in the Old Ice House were exposed to being struck-by large chunks of falling ice. Using a metal pole and a pick ax to move ice from the middle and top of a 12 foot ice pile, employees tunneled into the ice, creating an overhang of fused ice which broke loose from the top of the ice pile and fell on to an employee working below. Among others, one feasible and acceptable method to correct this hazard is to remove employees from the ice house and install an automatic ice rake.
