Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while trimming limbs from a tree: (a)On or about October 05, 2001, the employer did not ensure that an employee trimming limbs from a pine tree was tied-off or adequately secured while working at heights up to 45 feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the requirements of ANSI Z133.1, Section 9.1.2, which states, "Employees shall be tied-in or secured, while ascending the tree and to remain tied-in or secured until the work is completed and they have returned to the ground."
