P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazard of falling off a
platform that was
not firmly secured to the lifting carriage or forks:
A- Construction site - An employee was observed working from an elevated
platform,
approximately 20 feet high, which had not been provided with a guardrail
system and was
not firmly secured to the forks, on or about 09/17/2001.
OR IN THE ALTERNATIVE
29 CFR 1926.451(g)(1): Each employee on a scaffold more that 10 feet above
a lower level
were not protected from falling to that lower level:
A- Construction site - An employee was observed working from an elevated
platform,
approximately 20 feet high, which had not been provided with a guardrail
system and was
not firmly secured to the forks, on or about 09/17/2001.
