Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a.On or about September 7, 2001, Employees were exposed to the hazards of being crushed by or struck by the fork lifts overhead protection and/or the mast, carriage, forks or frame in that there was no requirement for the fork lift operators to wear seat belts on such equipment when so equipped. One feasible and useful method to abate this condition is to make it mandatory for operators to wear seat belts anytime they are operating a fork lift truck that is equipped with seat belts.ed
