Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Being struck by a forklift battery, weighing about 3150 pounds, due to using a metal and wood constructed below-the-hook lifting device that did not inform the user of the rated load of the device. Among other methods, one feasible and acceptable method would be to ensure the required permanent markings were attached to the device in accordance with the guidance given in ASME B30.20-1.2.1, 1996.
