Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by ejected parts: (a)At Southern Defense Systems, Inc. - Fadal CNC Vertical Milling Machine - The employer did not ensure that all components, auxillary equipment and parts were visually inspected to ensure the safe operation of the machine. Among other methods, one feasible and acceptable method to eliminate this hazard would be to ensure that thorough visual inspections of machine components, safeguarding devices and other auxillary equipment such as but not limited to, shop made shafts, bolts, nuts, tool holders and collettes are conducted in accordance with the requirement set forth in American National Standard B11.8-1974-Section 4.1.4., and the Operator's Manual for the Fadal Vertical Milling Machines.
