Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being run over by the Case 85XT skid steer (Bobcat) while working in close proximity to the operating machine. Among other methods, one feasible and acceptable method would have been to ensure that loads are secure and employees stay a safe distance away from operating machinery. a.On or about April 16, 2002, an employee was walking along side an unsecure load on a Case Steer Skid, model 85XT, SN JAF0268623, he was struck by and caught by the machine.23,

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries should the Clark fork lift being operated without the use of seat belts turns over. Among other methods, one feasible and acceptable method would have been to ensure that seat belts are installed and properly used. a.On or about April 19, 2002, an employee was observed operating a Clark fork lift with out the use of seat belts.
